VH® Sauces "Choose Your Fortune" Contest Rules
NO PURCHASE NECESSARY THIS CONTEST IS INTENDED FOR RESIDENTS OF CANADA ONLY AND IS SUBJECT TO APPLICABLE FEDERAL, PROVINCIAL AND MUNICIPAL LAWS OF CANADA
- Eligibility:
The VH “Choose Your Fortune” Contest (“Contest”) of ConAgra Foods Canada, Inc. (“Sponsor”) is open only to legal residents of Canada having reached the age of majority in their province or territory of residence, except employees, representatives and agents of Sponsor and its affiliates and advertising and promotional agencies, any contest judges or contest prize suppliers and any other companies engaged in the development, production, or distribution of materials for the Contest, as well as persons with whom such persons are domiciled. By entering the Contest, entrant agrees to abide by all of these contest rules (“Rules”). The Contest will commence at noon Eastern Time (ET) on January 1, 2010 and will run until noon ET on June 30, 2010 (“Contest Period”).
- How to Enter:
Visit the Contest page at www.vhsauces.com during the Contest Period to register for the contest. Complete and submit the online entry form in full, including your: e-mail address, password, first and last name, complete address, phone number and date of birth. Next, enter the 9 digit alphanumeric PIN located on the inside surface of the label of a participating VH product. There is no limit as to how many unique PINS may be entered per day. Only one (1) e-mail address may be used by any person to participate in the Contest. All entries must be received by June 30, 2010 at noon ET. In the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been made by the authorized account holder of the e-mail address submitted with the entry. Authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access or online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

- Grand Prize:
The Grand Prize winner will have the chance to choose one (1) (and only one (1)) of three (3) envelopes , each of which will contain a cash prize. One envelope will contain a cash amount of $10,000, the second will contain a cash amount of $20,000, and the third will contain a cash amount of $30,000. The cash amount in the one (1) envelope selected by the Grand Prize winner will constitute the Grand Prize.
Note: Prizes must be accepted as awarded and cannot be refunded, substituted, transferred, or exchanged.
- Winner Selection:
On or about July 1, 2010 a single Grand Prize winner will be chosen by random draw of a PIN code from all PIN codes of entries/entrants validly registered in accordance with these Rules. The name of the Grand Prize winner will be posted on the www.vhsauces.com website as soon as possible after the draw and in any event by July 30, 2010. The odds of winning depend on the number of valid entries into the contest.
- How to WIN and claim a prize:
The potential grand prize winner will be notified by phone or mail and instructed how to claim his/her prize. Before being declared a winner, a potential winner must first correctly answer a mathematical skill-testing question administered by phone and/or in person without assistance of any kind, whether mechanical or otherwise, must accept and sign the Contest Sponsor’s form of Declaration of Compliance and Release, and otherwise comply with the Rules. A potential winner may be required to furnish proof of identification that may include a driver’s license or other form of picture identification as part of the verification process. Once a potential winner has correctly answered the mathematical skill-testing question, accepted the Declaration of Compliance and Release form, and has been verified as a winner, an e-mail will be sent to the potential winner with details on how to claim the prize, which may be made in the form of a cheque. If a potential winner cannot be located within 3 days of selection, does not correctly answer the skill-testing question or execute the required Declaration of Compliance and Release within 3 days of notification of selection, or does not respond within 5 days of notification of how to claim a prize, the potential winner may be disqualified and forfeit the prize, with an alternative potential winner declared as chosen by random draw of a PIN code from all remaining PIN codes of entries/entrants validly registered in accordance with these Rules. The Contest Sponsor will not be responsible for failed attempts to notify any potential winner. The decisions of the official contest judges (who may be employees, agents or independent contractors of the Contest Sponsor) in respect of all matters pertaining to the Contest, including without limitation eligibility, validity, contents and/or disqualification of any entry, shall be binding and final without right of appeal.
Awarding of the prize is subject to verification and compliance with these Rules. Allow up to six (6) weeks for verification and prize fulfillment. No responsibility is assumed by the Contest Sponsor for any postal mail or overnight delivery returned as undeliverable without a forwarding address. No responsibility is assumed by Contest Sponsor for prizes after they have been awarded. Contest Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize. Winners bear all risk of loss or damages to prizes after delivery. Unclaimed prizes will not be awarded.
- Privacy
Certain information about entrants is required by Sponsor to administer the Contest and to verify and contact the winners. You are under no obligation to provide this information. By entering the Contest and/or claiming a prize, you expressly consent to Sponsor’s collection, use and disclosure of this information as provided herein, or as otherwise authorized or required by law. Except where entrant otherwise consents, all information obtained for this Contest will be used only for the purpose of conducting and administering the Contest and in connection with Sponsor’s publicity relating to the Contest. By claiming a prize in this Contest, claimant consents to the use of claimant’s name, city of residence, video image, likeness and/or photograph in any related publicity or Internet posting without further compensation.
- Additional Conditions and Details
By participating in this Contest, each entrant accepts and agrees to these Rules and all decisions of the Sponsor contest judges (who may be employees, agents or independent contractors of Sponsor), which shall be final and legally binding on the entrant in all matters relating to this Contest.
- The Publicity/Liability Waiver/Release to be executed by any Potential Winner, among other things: (1) releases the Sponsor and its affiliated companies, agencies, contest prize suppliers and their respective officers, directors, employees, agents, shareholders, officers, directors, members, employees, agents and assigns (collectively, the “Contest Group”) from all liability with respect to the entrant’s participation in this Contest and the awarding and use of the prize; and (2) provides that the Potential Winner agrees to the use of his/her name, comments, photograph, and other likeness for publicity purposes, and grants to the Sponsor all rights to said use without further compensation.
- By entering this Contest, each winner acknowledges and agrees that the Contest Group: i) shall have no liability of any kind whatsoever with respect to this Contest and/or the awarding or use of the prize, (ii) make no warranty, guaranty or representation of any kind concerning the prize, (iii) disclaim any implied warranty, and (iv) are not liable for injury, loss or damage of any kind resulting from the entrant’s acceptance or use of the prize or otherwise from such entrant’s participation in this Contest. The Contest Group is not responsible for typographical, printing, distribution, production or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Rules, the announcement of winners, or the distribution of the prizes.
- All entries become the property of the Sponsor. The Sponsor, in their sole discretion, reserve the right to amend, alter, change or edit any submissions. All rights to any material submitted, including but not limited to the right to display the material on television or online, and all promotional usage, shall belong to the Sponsor without any compensation in its sole discretion.
- Sponsor shall not be responsible for entries not received or entries ineligible because of incomplete, unclear, indecipherable information, failed network connections or other mechanical or technical problems, however caused, including a busy telephone signal. Sponsor assume no liability for lost, stolen, delayed, damaged, misdirected entries or requests or for any failure of the website during the Contest Period, for any problems or mechanical or technical malfunction of, or damage to, any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, for failure of any e-mail or entry to be received by Sponsor for any reason, including on account of mechanical or technical problems or traffic congestion on the Internet or at any website, or any combination thereof, for damage to an entrant's or any other person's computer or for breaches of privacy due to interference by any third party.
- The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (“Régie”) in Quebec, to modify the Contest if fraud destroys the integrity of the Contest as determined by the Sponsor, in its sole discretion. Furthermore, the Sponsor may, with the consent of the Régie in Quebec, withdraw, terminate or modify all or any part of the Contest at any time and for any reason, including but not limited to in the event of production, printing, tampering, unauthorized intervention, fraud or other unanticipated problems or irregularities or mistakes of any nature whatsoever not directly caused by the Sponsor which, in the opinion of the Sponsor affects the administration, security, fairness, integrity or proper conduct of the Contest, or the odds of winning. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should an attempt be made to do so, Sponsor reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
- Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
- This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited or restricted.

1. About Your Privacy

As part of this commitment, we have adopted the following ten principles, based on the values set by the Canadian Standards Association's Model Code for the Protection of Personal Information and Canada's PIPEDA.
(a) Accountability: ConAgra Foods Canada is responsible for maintaining and protecting the personal information under its control and shall designate one or more individuals to be accountable for compliance with these principles, including a Privacy Officer. (b) Identifying Purposes: The purposes for which personal information is collected shall be identified before or at the time the personal information is collected. (c) Consent: Individual's consent will be obtained for the collection, use or disclosure of personal information, except where the law provides an exemption. (d) Limiting Collection: The personal information we collect shall be limited only to that which is necessary for the purposes identified. (e) Limiting Use, Disclosure and Retention: Personal information shall only be used or disclosed for the purposes for which it was collected, unless an individual has otherwise consented or when it is required or permitted by law. Personal information shall be retained only as long as necessary for the fulfillment of those purposes. (f) Accuracy: We shall keep personal information as accurate, complete and up-to-date as may be necessary to fulfill the purposes for which it is to be used. (g) Safeguards: We shall protect personal information using security safeguards that are appropriate to the sensitivity level of the personal information received. (h) Openness: ConAgra Foods Canada will provide information to individuals about our policies and procedures relating to the management of personal information that is under our control. (i) Individual's Access: On written request to our Privacy Officer, an individual will be informed of the existence, use and disclosure of their personal information that is under our control, and may be given access to that personal information as required and permitted by law. Individuals are entitled to challenge the accuracy and completeness of that personal information and request that it be amended, if appropriate. (j) Handling Enqui ries or Comp laints: Any questions or enquiries concerning compliance with our privacy policies and procedures may be addressed to our Privacy Officer, as set out below.
3. Why We Collect and Use Personal Information
(1) ConAgra Foods collects personally identifiable information from visitors to our sites solely on a voluntary basis and only such personal information as is required to fulfill the purposes set out below. Such personally identifiable information may include your name, postal address, e-mail address, company name and/or telephone numbers, et cetera. Only those employees at ConAgra who require your personal information will have access to it.
(2) ConAgra Foods collects personal information primarily for the following reasons: (a) to respond to customer inquiries; (b) in connection with considering and evaluating applications for employment e-mailed to ConAgra; (c) to e-mail consumers with updates and news; (d) to notify winners of contests, games and sweepstakes, and to distribute prizes; (e) to send out brochures, etc. via regular mail to subscribers; (f) to distribute items that are part of "give aways" that you have registered for; and (g) for use in our online and off-line marketing and advertising campaigns.
(3) Personal information may also be used for other purposes, subject to obtaining your prior consent for such use.
(4) Aggregate Information: There may be times when we share aggregate information about our users (for example, the % of male and female visitors to our sites), with advertisers, business partners, sponsors, and other third parties in an effort to customize or enhance the content and advertising on our sites for our users, but only in a way that does not permit any user to be identified.
(5) Contests/Sweepstakes: We periodically run contests and sweepstakes on our sites for which we ask users/participants to provide contact information (like their e-mail address). This information is used to contact the participant only when necessary in accordance with the rules of the contest or sweepstakes. If a participant has indicated upon entering a contest or sweepstakes that he/she is under 13 years of age, the participant is instructed to enter the e-mail address of his/her parent or guardian. Further, for any game or contest where the screen names of the high scorers are posted, a user under 13 can only select a generic screen name from a list that has been developed in advance. This prevents the disclosure to third parties of any personally identifiable information. When a participant under the age of majority in the province of his or her residence is selected as a prize-winner in a contest or sweepstakes, an e-mail is sent to the parent or guardian. This e-mail contains a form that requests the participant's real name and address and a parental permission form. In order for the participant to receive the prize, the parent or guardian must fill out and sign the form and then mail or fax it to the address or number indicated on the form.
(6) Polls & Surveys: Information gathered from polls and surveys are only for internal use of ConAgra Foods. If sample answers to polls or surveys are posted on the web site, then no identifiable Personal Information is ever included.
(7) Choice/Opt-out: Our sites will provide users the opportunity to opt out of receiving communications from us at the point where we request information about the visitor. Simply follow the procedure outlined at each site. Likewise, we will provide users with the opportunity to change any personal information previously provided, or to opt out of receiving future email communication from us.
4. Consent To Use Personal Information
(1) Consent may be obtained in various ways. We may obtain your express consent or we may determine that consent has been implied by the circumstances. Express consent could be in writing (for example in a signed consent, e-mail or application form), or verbally in person or over the telephone. When we receive personal information from you that enables us to provide you with a requested product or service, your consent to allow us to deal with that personal information in a reasonable manner would be implied. If you need to provide personal information about other individuals (such as dependants), you must first obtain their consent for these purposes prior to your disclosure to us.
(2) Providing us with your personal information is always your choice. When you request services from us, we ask that you provide information that enables us to respond to your request. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such personal information for these purposes. You also authorize us to use and retain this personal information for as long as it may be required for the purposes described above. Your consent remains valid unless you provide us with written notice that such consent is withdrawn.
(3) There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of personal information. For example, an exception would apply if there is an emergency that threatens the life, health or security of an individual, or if we must comply with a court order.
(4) Children: We recognize there are unique issues raised about the protection of our children's privacy over the Internet. All ConAgra Foods web sites are designed to comply with the requirements of the PIPEDA and all applicable provincial privacy legislation for web sites gathering identifiable information from individuals and particularly from children. In particular, with respect to personal information collected from children we would advise that we distinguish between "off-line" and "on-line" contact information. We would also advise that, consistent with these requirements and guidelines, and provided that we have been given accurate information by the child when asked, we do NOT: (a) collect personally identifiable off-line contact information from children under 13 without prior parental consent (b) distribute to third parties any personally identifiable information of a child without prior parental consent; (c) entice children by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity; (d) use or disclose on-line contact information without prior parental consent; (e) collect on-line contact information from children other than in connection with on-line contests and sweepstakes; or (f) enable children to publicly post or otherwise distribute personally identifiable contact information without prior parental consent.
As with those whose personal information has been collected, parents can always ask to review any personal information about their child that has been collected at one of our sites, have us delete any such personal information, and/or instruct us not to collect or use such personal information about their child in the future. To do so, simply contact us following the procedure outlined below in "How To Contact Us".
5. Sharing Personal Information With Others
(1) We are not in the business of selling client lists or personal information to others. In providing our services, we may need to disclose the personal information we collect to affiliates, subsidiaries, successors and other service providers or agents who perform various functions for us. When we have your consent to collect, use or disclose personal information, this consent extends to the disclosure of your information to these others for the purpose of providing these various functions for us.
(2) We will never sell, transfer, or disclose any personal information we gather at our web sites to any third parties without your prior consent, except in cases when we believe in good faith that we have a legal obligation to disclose such personal information or where the law permits us to disclose. We never require that this personal information be provided in order to gain access to our sites.

(2) Despite our best efforts, errors sometimes do occur. If you identify any personal information that is out-of-date, incorrect or incomplete, let us know and we will make the corrections promptly and use every reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date personal information from us.
(3) You have the right to access the personal information which ConAgra Foods Canada has collected about you at any time and rectify such information if it contains any errors. In order to exercise your right of access, please contact ConAgra's Privacy Officer (see below).
7. How We Safeguard Personal Information
(1) At ConAgra Foods Canada, we employ physical, electronic and procedural safeguards to protect our systems and all personal information under our control against unauthorized access and use. All safety and security measures are appropriate to the sensitivity level of the information collected.
(2) Our service providers and agents are required to maintain confidentiality with respect to all personal information, and may not use the information for any unauthorized purpose.
(3) Employees are governed by standards and policies to ensure that personal information is secure and treated with the utmost care and respect.
8. Privacy and the Internet
(1) ConAgra Foods Canada may collect user information from its Web sites (for example, via cookies which are alphanumeric identifiers transmitted from a Web site to a visitor's browser and IP address). This information is used solely for enabling us to provide you with a customized online experience and to find ways to improve our site (including by helping diagnose problems with our web server). Although cookies are widely used, it may be possible to disable cookies via your browser settings. However, in so doing, some Web sites may not function properly or optimally.
(2) The cookies ConAgra Foods uses do not contain any personally identifying information and cannot profile your system or collect information from your hard drive. You are not identified by name or e-mail address, just by a unique string of numbers that we assign the first time you come to our site.
(3) ConAgra Foods Canada Web sites may contain links to other third party sites that are not governed by this privacy policy. (5) Contests/Sweepstakes: We periodically run contests and sweepstakes on our sites for which we ask users/participants to provide contact information (like their e-mail address). This information is used to contact the participant only when necessary in accordance with the rules of the contest or sweepstakes. If a participant has indicated upon entering a contest or sweepstakes that he/she is under 13 years of age, the participant is instructed to enter the e-mail address of his/her parent or guardian. Further, for any game or contest where the screen names of the high scorers are posted, a user under 13 can only select a generic screen name from a list that has been developed in advance. This prevents the disclosure to third parties of any personally identifiable information. When a participant under the age of majority in the province of his or her residence is selected as a prize-winner in a contest or sweepstakes, an e-mail is sent to the parent or guardian. This e-mail contains a form that requests the participant's real name and address and a parental permission form. In order for the participant to receive the prize, the parent or guardian must fill out and sign the form and then mail or fax it to the address or number indicated on the form.
(6) Polls & Surveys: Information gathered from polls and surveys are only for internal use of ConAgra Foods. If sample answers to polls or surveys are posted on the web site, then no identifiable Personal Information is ever included.
(7) Choice/Opt-out: Our sites will provide users the opportunity to opt out of receiving communications from us at the point where we request information about the visitor. Simply follow the procedure outlined at each site. Likewise, we will provide users with the opportunity to change any personal information previously provided, or to opt out of receiving future email communication from us.
4. Consent To Use Personal Information
(1) Consent may be obtained in various ways. We may obtain your express consent or we may determine that consent has been implied by the circumstances. Express consent could be in writing (for example in a signed consent, e-mail or application form), or verbally in person or over the telephone. When we receive personal information from you that enables us to provide you with a requested product or service, your consent to allow us to deal with that personal information in a reasonable manner would be implied. If you need to provide personal information about other individuals (such as dependants), you must first obtain their consent for these purposes prior to your disclosure to us.
(2) Providing us with your personal information is always your choice. When you request services from us, we ask that you provide information that enables us to respond to your request. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such personal information for these purposes. You also authorize us to use and retain this personal information for as long as it may be required for the purposes described above. Your consent remains valid unless you provide us with written notice that such consent is withdrawn.
(3) There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of personal information. For example, an exception would apply if there is an emergency that threatens the life, health or security of an individual, or if we must comply with a court order.
(4) Children: We recognize there are unique issues raised about the protection of our children's privacy over the Internet. All ConAgra Foods web sites are designed to comply with the requirements of the PIPEDA and all applicable provincial privacy legislation for web sites gathering identifiable information from individuals and particularly from children. In particular, with respect to personal information collected from children we would advise that we distinguish between "off-line" and "on-line" contact information. We would also advise that, consistent with these requirements and guidelines, and provided that we have been given accurate information by the child when asked, we do NOT: (a) collect personally identifiable off-line contact information from children under 13 without prior parental consent (b) distribute to third parties any personally identifiable information of a child without prior parental consent; (c) entice children by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity; (d) use or disclose on-line contact information without prior parental consent; (e) collect on-line contact information from children other than in connection with on-line contests and sweepstakes; or (f) enable children to publicly post or otherwise distribute personally identifiable contact information without prior parental consent.
As with those whose personal information has been collected, parents can always ask to review any personal information about their child that has been collected at one of our sites, have us delete any such personal information, and/or instruct us not to collect or use such personal information about their child in the future. To do so, simply contact us following the procedure outlined below in "How To Contact Us".
5. Sharing Personal Information With Others
(1) We are not in the business of selling client lists or personal information to others. In providing our services, we may need to disclose the personal information we collect to affiliates, subsidiaries, successors and other service providers or agents who perform various functions for us. When we have your consent to collect, use or disclose personal information, this consent extends to the disclosure of your information to these others for the purpose of providing these various functions for us.
(2) We will never sell, transfer, or disclose any personal information we gather at our web sites to any third parties without your prior consent, except in cases when we believe in good faith that we have a legal obligation to disclose such personal information or where the law permits us to disclose. We never require that this personal information be provided in order to gain access to our sites.
(3) In certain circumstances, we may be required to provide personal information to third parties for legal or regulatory purposes.
(4) We may also use this personal information to assess your future needs and to offer the products and services that may best meet those needs, from ourselves or our affiliates.
6. Keeping Information Accurate
(1) It is important that your personal information is accurate and complete. Having accurate information about you enables us to give you the best possible service. You have the right to access, verify and amend the information we have about you. We rely on you to keep us informed of any changes, such as a change of address, telephone number or any other circumstances - simply contact us at int.ca@conagrafoods.com
(2) Despite our best efforts, errors sometimes do occur. If you identify any personal information that is out-of-date, incorrect or incomplete, let us know and we will make the corrections promptly and use every reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date personal information from us.
(3) You have the right to access the personal information which ConAgra Foods Canada has collected about you at any time and rectify such information if it contains any errors. In order to exercise your right of access, please contact ConAgra's Privacy Officer (see below).
7. How We Safeguard Personal Information
(1) At ConAgra Foods Canada, we employ physical, electronic and procedural safeguards to protect our systems and all personal information under our control against unauthorized access and use. All safety and security measures are appropriate to the sensitivity level of the information collected.
(2) Our service providers and agents are required to maintain confidentiality with respect to all personal information, and may not use the information for any unauthorized purpose.
(3) Employees are governed by standards and policies to ensure that personal information is secure and treated with the utmost care and respect.
8. Privacy and the Internet
(1) ConAgra Foods Canada may collect user information from its Web sites (for example, via cookies which are alphanumeric identifiers transmitted from a Web site to a visitor's browser and IP address). This information is used solely for enabling us to provide you with a customized online experience and to find ways to improve our site (including by helping diagnose problems with our web server). Although cookies are widely used, it may be possible to disable cookies via your browser settings. However, in so doing, some Web sites may not function properly or optimally.
(2) The cookies ConAgra Foods uses do not contain any personally identifying information and cannot profile your system or collect information from your hard drive. You are not identified by name or e-mail address, just by a unique string of numbers that we assign the first time you come to our site.
(3) ConAgra Foods Canada Web sites may contain links to other third party sites that are not governed by this privacy policy. Although we endeavour to link only to sites with high privacy standards, our Privacy Policy will no longer apply once you leave a ConAgra Foods Canada Web site. We are not responsible for privacy policies employed by other third parties or any foreign affiliates (including the "www.conagrafoods.com'' Web site managed by our affiliate in the United States). We suggest, therefore, that you examine the privacy statements of those sites to learn how personal information may be collected, used and/or disclosed.
